An important Superior Court decision came through this week, which affirms the 2022 case, where Attorney Barrault convinced an independent Arbitrator to agree with Massport Firefighters Local S-2 and agreed that an employee cannot be disciplined under rules involving the use of marijuana, which is legal in Massachusetts, if those rules are not clearly communicated and understood. This is an important win as more cases will be following.
